Key points

  • California approved the permanent list regulations on 19 June 2026.
  • Covered products absent from the list are treated as prohibited flavored tobacco products.
  • Empty devices and specified tobacco categories are outside the list’s coverage or subject to exemptions.

California’s Office of Administrative Law approved permanent regulations for the Unflavored Tobacco List on 19 June 2026. The approval letter covers the process for adding products to the list, maintaining it and enforcing its requirements.

The framework implements Assembly Bill 3218, which took effect on 1 January 2025 and expanded the state’s flavored-tobacco restrictions. According to the Attorney General’s rulemaking record, the regulations address applications from manufacturers and importers, required information, fees and enforcement procedures. This is an administrative development, rather than a new court ruling.

The public list identifies specific product brand styles certified by manufacturers or importers as lacking a characterizing flavor. A covered product that is absent is classified as prohibited under the state’s flavor rules. For sellers, checking a brand name alone is therefore insufficient: the relevant product style matters.

Coverage also has boundaries. The portal says electronic devices sold without nicotine or liquid are not covered. It describes exemptions for loose-leaf pipe tobacco, qualifying premium cigars and certain age-restricted hookah sales. Local authorities may impose stricter rules. A listing establishes a product’s position within this particular state framework; readers should not treat it as a general assurance about every legal requirement affecting a sale.
