France’s disposable-vape ban turns on refillability, not battery charging
The prohibition in force since 26 February 2025 covers prefilled devices that cannot be refilled, including rechargeable models.
Key points
- France’s disposable-vape sales prohibition began on 26 February 2025.
- A rechargeable battery does not exempt a device that cannot be refilled.
- The official guidance excludes e-cigarette cartridges from this specific device ban.
France prohibited the sale and free distribution of disposable vapes on 26 February 2025. The rule targets prefilled devices whose liquid cannot be replenished, including products fitted with rechargeable batteries. The government’s public-service explanation links the change to the law dated 24 February 2025.
The design distinction matters. A charging port can extend battery life without making the liquid reservoir refillable. Under the consumer regulator’s guidance, that kind of sealed prefilled device remains within the prohibition. The same guidance explicitly excludes e-cigarette cartridges from this particular ban.
The restrictions reach beyond completed purchases. They also cover offering the devices for sale, distributing them without payment, and holding them for those purposes in France. Official guidance says manufacturing or importing them exclusively for sale outside France remains permitted. That qualification should not be mistaken for permission to place disposable products on the French market.
This is an account of an existing device restriction, not a newly announced packaging measure. Nor does the cartridge exception remove the other rules applying to vaping products. The consumer regulator separately describes obligations concerning labeling and product safety. For understanding this ban, the key question is whether the device can receive more liquid, rather than whether its battery can be charged again.
