Australia’s vape framework centres on pharmacies and product standards

Official TGA guidance sets out pharmacy supply restrictions and strengthened product standards; these regulatory documents do not measure sales.

Key points

  • Non-pharmacy retailers cannot lawfully supply vapes under Australia's national framework.
  • Therapeutic supply is subject to clinical requirements and state or territory rules.
  • Strengthened product standards took effect for supply on 1 July 2025; regulatory requirements are not sales statistics.

Australia’s legal vaping market operates through a therapeutic pharmacy framework, rather than ordinary vape-shop retail. TGA guidance for retailers says vapes cannot be supplied by non-pharmacy outlets, including tobacconists, convenience stores and vape shops.

The broader reforms that commenced in July 2024 prohibit commercial supply of disposable and non-therapeutic vapes, regardless of nicotine content. Therapeutic supply remains subject to clinical requirements and state or territory laws. The later prescription changes did not create a general retail exemption.

A second stage concerns the products themselves. From 1 July 2025, strengthened requirements applied to therapeutic vaping goods supplied in Australia. The TGA’s June 2025 explanation identifies tighter ingredient rules, plain packaging, information leaflets and device standards covering matters such as battery and electrical safety.

The regulator also distinguishes a sponsor’s notification of compliance from an evaluation of a product. Its standards guidance warns that compliance does not guarantee safety, quality, efficacy or performance.

These documents establish conditions for lawful supply, not the volume of products sold. They do not quantify changes in disposable sales or isolate the effect of import restrictions on commercial activity. A credible market assessment would need a defined period, a transparent sales dataset and an explanation of whether it measures legal supply, illicit activity or both.
