State Vape Directory Laws: Which States Require a Product Listing

Last updated October 30, 2026

Status: state entries last reviewed against official sources on October 30, 2026.

A growing number of states allow only vapor products that appear in a state directory to be sold. Each listing rests on a certification filed by the product’s manufacturer, and an unlisted product can be seized and its seller penalised. The table covers states VapeBrief has checked against the state’s own legislation or agency page.

States still being checked

A May 2026 overview by the compliance company Token of Trust also names directory laws in Arkansas, Georgia, Indiana, Kentucky, Mississippi, South Carolina and West Virginia. VapeBrief adds a state to the table only after checking it against that state’s own legislation or agency page.

What a listing does and does not mean

A state listing means a manufacturer has certified a product to that state. It is separate from FDA marketing authorization, which covers far fewer products and is tracked on our FDA authorized vapes page. Directories change monthly or more often, so retailers and distributors should check the state’s own search tool before buying or shipping stock.
